Protect Housing Appeals Board
NHAR is asking for your help in protecting property owners by taking one minute to tell your legislator to vote to protect the new Housing Appeals Board.
The Housing Appeals Board, which was established in 2019, simply provides a less expensive appeal process from a decision of a local land use board than the current procedure of going to the Superior Court. Instead of a two-year court battle, the Housing Appeal Board is mandated to reach a decision within a few months, saving thousands of dollars for all those involved. This new Board must follow the same standard of review as the Superior Court, and each of its three Commissioners are appointed by the New Hampshire Supreme Court.
House Bill 288 would eliminate the Housing Appeals Board. NHAR has testified against the bill, and the House Judiciary Committee agreed with our position, recommending that the legislation is Inexpedient to Legislate (ITL). However, we are not out of the woods, as the full House will vote on the measure next week.
